Terms & Conditions

The following terminology applies to this Terms and Conditions, Privacy Statement and Disclaimer Notice, and any or all Agreements: “You”, “Your”, "Client", or "Customer" refers to you, the person accessing this website and accepting Tres Chic Luxury Picnics & Parties LLCs Terms and Conditions.  “The Company”, “Ourselves”, “We” and “Us”, refers to the company, Tres Chic Luxury Picnics & Parties LLC.  “Party”, “Parties”, or “Us”, refers to both the Client and Tres Chic Luxury Picnics & Parties LLC, or either the Client or Tres Chic Luxury Picnics & Parties LLC.  Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same. 

In using this website You are deemed to have read and agreed to the following Terms and Conditions, which may be updated or changed from time to time by Tres Chic Luxury Picnics & Parties LLC without notice to You.  If You do not agree with any of the Terms and Conditions, do not use this website or our services. Because our services are evolving over time, We may change or discontinue all or any part of our services, at any time and without notice, at our sole discretion. Your continued use of this website following the posting of any changes to this Terms and Conditions constitutes acceptance of those changes.

PAYMENTS

A nonrefundable deposit must be paid when booking to hold the scheduled dates. An invoice with remaining balance plus security deposit will be emailed and must be paid in full 24 hours prior to the event. The event setup will not occur without full payment.

* A travel fee will be applied for beaches and any locations outside of Mobile, AL. 

CANCELLATION

Notice must be provided no less than 24 hours in advance and the rescheduled date is subject to availability. If no notice is provided deposit is lost and booking can not be rescheduled. There are no cancellation charges for rescheduling your event. You have up to 3 months to reschedule and must be of equal or higher value.

In the case of rain/wet weather for picnics, the Client has up to 48 hours prior to the scheduled date to decide if they want to make alternate arrangements at an indoor location or reschedule the event. The Client has a 3 month limit following the cancelled event for rescheduling and must be of equal or higher value. 

REFUND POLICY

Tres Chic Luxury Picnics & Parties LLC does not offer refunds for deposits once payment has been received. Refunds will not be offered in the event of inclement weather. If there’s bad weather in the forecast we will contact you before the picnic and offer you to reschedule, or we will offer a home set up. Travel fees might apply depending if the location is outside of Mobile, AL.

ALCOHOL CONSUMPTION

It is the responsibility of the customer to check alcohol laws of any venue or public space being used for our pop-up picnics. Public parks and beaches are prohibited from drinking and a fine can be issued.  Tres Chic Luxury Picnics & Parties LLC takes no responsibility for any alcohol consumption or penalties.

FOOD CONSUMPTION

We are not responsible for any food allergies or any issues or illness caused from foods that were consumed or purchased through Tres Chic Luxury Picnics & Parties or from third party vendors.

USE OF EQUIPMENT

All Equipment supplied on hire is the property of Tres Chic Luxury Picnics & Parties LLC.

 

Any damage, loss or extensive cleaning will result in a fee to the Client.

 

The Client shall be responsible for any loss or damage to any items such as plates, goblets, ceramic bowls/plates, vases, props, tents, mattresses, lanterns, and other decorations. Fees will apply for replacement at the full cost of purchasing a replacement. These fees are payable within seven days of such loss or damage unless agreed otherwise.

 

The Client shall pay for all equipment damage or loss incurred during their event. Damage includes but is not limited to;

  • Improper use of equipment

  • Disappearance of the equipment

  • Damage to, or loss of, the equipment from any unknown cause

  • Cigarette burns on any furniture or décor items. Smoking is not permitted on or near the property of Tres Chic Luxury Picnics & Parties LLC.

  • Staining product spillages or stains on any furniture or décor items

With the exception of battery-powered candles, no candles, fires or other flammable properties are to be lit during the booking. 

IMAGE RELEASE

In the event that photographs of your picnic or sleepover has been taken by us or shared either on social media by anyone, Tres Chic Luxury Picnics & Parties LLC reserves the right to use such photographs in its promotional materials.  

LIABILITY

Tres Chic Luxury Picnics & Parties LLC shall in no way be held responsible or accountable for any damage, injury, illness, death or loss of income caused to the client, any third parties or properties due to the hire of equipment or provided services by Tres Chic Luxury Picnics & Parties LLC. All equipment is hired and is the responsibility of the client until returned to Tres Chic Luxury Picnics & Parties LLC.

FORCE MAJEURE

Tres Chic Luxury Picnics & Parties LLC shall not be liable for any failure or delay in delivery or otherwise performing its obligations hereunder with respect to any goods or services being purchased if such failure or delay is caused by law, a strike, lockout, labor dispute, accident, war, act of terrorism, act of God, fire, flood, or other casualty or cause beyond Tres Chic Luxury Picnics & Parties LLCs  reasonable control.
